General Sale Terms and Conditions

This contract describes the general terms and conditions (the “General Terms and Conditions”) that apply to the services that Lakauta offer (the “Services”) in the web site www.lakauta.com (“Lakauta” or the “web site”). Anyone who wishes to access and/or use the web site or its services can do it according to the General Terms and Conditions; plus all the policies and principles that govern Lakauta and that are bound to this document. All purchases you make from Lakauta are ruled by the General Conditions described in this document.

Lakauta’s legal address is: Calle 10 de Obrajes No 212, La Paz - Bolivia.

Antecedents:
The purpose of the www.lakauta.com web site is to sell and promote products and services of artisans, groups of micro and small Bolivian firms to all internet users. Each person that purchases from www.lakauta.com will be considered a buyer.

Acceptance:
The buyer should declare the knowledge and acceptance of this General Sale Terms and Conditions before confirming the order. Validating your order implies the acceptance of these General Sale Terms and Conditions. ANYONE WHO DOES NOT ACCEPT THIS GENERAL SALE TERMS AND CONDITIONS, WHICH ARE OBLIGATORY AND BINDING, SHOULD ABSTAIN FROM USING THE SITE AND/OR THE SERVICES.

Shipment:

• Most of the time the products we offer are available for immediate shipping; however there might be some situations in which the shipping could be delayed because of the following reasons:

• Colors not available at the time.
• Size not available at the time.
• Customize a product may take longer.
• Artisans are human beings who could eventually face some production problems.

Therefore the times of shipping and arrival may vary from the ones detailed on the web. However we will always keep you informed about your order situation. Once your purchase is confirmed you will receive a confirmation mail including the date of shipment.

• Shipment will be made to the address you detailed when you made your order. Shipment will be made through the Bolivian Post Office. If you wish your order to be shipped through a different company, you must specify when you are making your order.
• In case there is a problem with your shipment: time of delivery or non reception of the order, please let us now by writing an e-mail to contact@lakauta.com so we can track the package and make the complaint to the shipping company. However, the client must understand that once Lakauta.com sends the package, the shipping company becomes responsible for its delivery until it arrives to destiny.
• It’s the client’s responsibility to find out if there are any types of restrictions for purchasing any kind of products from Bolivia offered by Lakauta.com..

Returns:

• If the buyer receives what he/she ordered but still wishes to return or exchange it, there is no problem. In this case shipment charges will be covered by the buyer. Products must be returned in their original packages and without any damage.
• For special orders with specific colors, design, measure or any other detail, the return or exchange won’t be possible because the product has been specially made for the buyer. Returning food products is also not possible.
• Once the order arrives to destiny, the buyer has 3 business days to return or exchange the product (s), after that any exchange or return will be possible.
• In case there is a mistake or a missing product in the order the buyer receives and the mistake was made by Lakauta.com, he/she should write to us to contact@lakauta.com. Lakauta.com will exchange or complete the order as soon as possible and pay for shipment.
• When an order is returned Lakauta.com will reimburse the price of the product within 30 days after receiving the package back. However, if the product is damaged, incomplete or dirty, reimbursement will not take place.
• When the buyer purchases any product from Lakauta.com he/she must be aware that they are hand made products. Therefore, none of them will be exactly the same, sometimes there may be small differences between the picture shown in the web and the product he/she receives.
• Then the rule of thumb for devolutions is: If there was an error with your order and the fault was made by Lakauta.com, then Lakauta.com will assume all the devolution costs. If the order is returned but the mistake wasn’t made by Lakauta.com, then the buyer will have to assume all the devolution costs.

• In case there would be something wrong with the products the client receives (broken, damaged or wrong item), the client should contact Lakauta.com to contact@lakauta.com in no longer than 3 working days from receiving the package.

Price:

• The total price the client pays for an order includes: products cost, handling, packaging and shipping.
• The price does not include customs rights and taxes or other taxes in the country. The client is responsible for paying the customs rights and taxes or other taxes (in case there are any).
• Prices are expressed in American dollars or euros, depending on the option the client chooses.

Product Availability:

• Lakauta.com works with its own stock of products. Once an order is confirmed we send the product(s) as soon as possible. However, in case a product is not available at the moment or it would take longer to arrive, the client will be informed by e-mail about the evolution of the order.

Safe Payment:

• Lakauta.com Works with the Secure Payment System of PAYPAL enterprise (http://www.paypal.com)
• Lakauta.com does not have any access to the client’s credit card number. Therefore, Lakauta.com. is not responsible for any fraudulent actions with the client’s credit card.

Method of Payment:

• Lakauta.com accepts payments with credit cards made through PAYPAL (payment security system).
• Lakauta.com also accepts other methods of payment such as money transfers to a bank account or direct money transfers through Western Union.

Customer Service:

• For any question, complaint or information, the client can write an e-mail to contact@lakauta.com from Monday to Saturday (business hours). Remember there might be a time difference between Bolivia and your country.

Confidentiality of the information:

• The client’s personal information by no means will be transmitted to third parties. Lakauta.com keeps an information record. The client can verify and change the information any moment.

Ownership and Risks:

• The transfer of ownership from Lakauta.com towards the buyer is done once the payment was made (shipment cost included).
• Once the shipment has been made, the succeeding risks will be the client’s responsibility.

Intelectual Property - Links:

• All Lakauta.com contents related to services as well as the programs, data base, webs and files that allow the User to access and use his/her account, are property of Lakauta.com and they are protected by the laws and international agreements for author’s copyright, labels, patents, model and industrial designs. Non authorized use and partial or total reproduction of these contents are prohibited, except with written authorization from Lakauta.com.
• The site may contain links to other web sites which does not mean that they are property or operated by Lakauta.com. Since Lakauta.com does not have any control over those sites, it will NOT be responsible for their contents, materials, actions and/or services or for any damage or losses caused by them, directly or indirectly. The presence of links to other web sites does not imply society, relationship, approval or support from Lakauta.com to those web sites and their contents.

Agreement Modifications:

• Lakauta.com will be able to modify its General Terms and Conditions at any moment and publish the modified terms in the Site. All modified terms will be applicable 10 (ten) days after they have been published.

Jurisdiction and Applicable Law:

• This agreement is based in all its aspects on the Bolivian Laws.
• Any controversy due to the present agreement, its existence, validity, interpretation, scope or fulfillment will be submitted to the applicable laws and the competent Courts of the City of La Paz and the procedures will be done in Spanish.
